Flood Disclosure For Rentals
As of March 20, 2024 landlords will be required to disclose if the property is in a flood zone prior to any lease or renewal signing. The disclosure must be signed by both the tenant and the landlord.
Even if the structure of the home is not in a flood zone, if any part of the property is in a flood zone that could negatively impact the tenant, notice must be given. For example, if the house isn’t in a flood zone but the area where the tenant parks on the property is. As a Realtor, I highly suggest landlords disclose if any part of the property is in a flood zone.
If you are unsure if the property you own or rent is in a flood zone, you can check the FEMA site, or you can reach out to me and I can assist.
Note to my landlords: While this legislation was enacted sooner than anticipated, I knew it was proposed so it is written into all of my leases in the past year and a half which was signed by both you and the tenant. If you need a copy of the disclosure for any lease renewals, please let me know.
